What forms do you need to apply for a divorce?
To obtain a Divorce Order in Ontario, you typically need to file several specific forms during the divorce process, culminating in the application for the divorce certificate.
- Form 36: Affidavit for Divorce
- Copy of Marriage Certificate
- Form 25A: Divorce Order
What is included in each of these essential forms?
- Form 36: Affidavit for Divorce: This form is an affidavit where one or both spouses confirm the facts of the divorce application, including the grounds for divorce and the particulars of the marriage and separation. where you include information about you and your partner, your children, and any arrangements made after separating about decision-making responsibility, parenting time, child support and spousal support. This form must be sworn or affirmed. It needs to be sworn or affirmed in front of a commissioner for taking oaths.
- Copy of Marriage Certificate – If you can’t get a copy of your marriage certificate, you need to explain the reason why in your Form 36: Affidavit for Divorce
- Form 25A: Divorce Order: This form is what the judge signs to grant the divorce. It outlines the court’s decision regarding the divorce and confirms that the requirements for divorce (such as the one-year separation, unless adultery or cruelty were the grounds) have been met.
What happens if you don’t have a copy of your marriage certificate?
For a fee, you can get a copy of your marriage certificate from Service Ontario.
What happens if your marriage certificate is in another language?
If you were married outside of Canada, and your marriage certificate is not in English, you must have it translated by a certified translator. You can find certified translation services online.
